Court StuffJudge Toth is the District Court Judge conducting the Judicial Review of the School Board's Decision in this case. It is likely, based on what he stated in the Injunction Order, that he is going to rule in our favor. The school board has already made it clear that they intend to appeal his ruling. In this regard, Judge Toth presides over the largest juvenile district court in the state. He has been a Judge/Magistrate for 19 years (in Colorado Springs). He has been appealed 5 times (as of 5/98). His decision has been reversed by an Appellate Judge only once. I guess the School Board likes a long shot. That long shot has become even greater because on March 11, 1999 when the Appellate Court upheld the injunction Judge Toth issued in May of 1998. This means among other things that the Appellate Court agreed with Judge Toth's preliminary assessment that we (the parents) "had a reasonable probability of success on the merits" pending a full hearing.
